Terms and Conditions

By signing up for the Choose Fresh Monthly Program of Kerr Street Mission you are agreeing to be bound by the following terms and conditions (“Terms of Service”). Any other services or programs which are added to the current existing program shall also be subject to the Terms of Service. Kerr Street Mission reserves the right to update and change the Terms of Service by sending direct email communication.

You are advised to keep these emails as a record as these updates and changes may directly impact you. You must read, agree with, and accept all the terms and conditions contained in this Terms of Service agreement before being registered for the Choose Fresh Monthly Program.

1. Account Terms

a) You must be a registered qualifying client or representing a registered qualifying client of Kerr Street Mission to access the Choose Fresh program each month.

b) To register for this program, you must sign-up by the 10th day of the month before the month that your registration will take effect (e.g. sign-up on the 9th of May will take effect in June when you will be able to access your Choose Fresh products).

c) You acknowledge that Kerr Street Mission will use the email address you provide as the primary method for communication.

d) Any breach or violation of any term in the Terms of Service as determined by the sole discretion of Kerr Street Mission may result in the removal of your participation in the Choose Fresh Monthly Program.

2. Program Activation and Participation

a) Subject to section 2.b, the person signing up for the Service will be responsible for upholding the Terms of Service and held accountable for any breach or violation.

b) If you are signing up for the Program on behalf of a registered Kerr Street Mission client, the client will be the one that is able to access the Program. If you are signing up for the Program on behalf of a registered Kerr Street Mission client, then you warrant that you have the permission and/or authority to represent the client and are bound to our Terms of Service.

c) Upon completion of sign up for the Program, Kerr Street Mission will collect your credit card information and store it on a secure server.

d) If you do not wish to continue accessing the Choose Fresh Monthly Program, it is your responsibility to contact Kerr Street Mission to cancel your participation. This must be done before the 10th day of the month before your cancellation takes effect.

e) The choices for Choose Fresh products will be locked and cannot be changed for the month that you have been charged for (e.g. payment and choices made in May will remain the same throughout June). If you would like to make a change for the following month, this request must be submitted by the 25th of the month before the change takes effect (e.g. Request by August 25th for the change to be made for September). Change requests can be made by calling Kerr Street Mission and/or emailing admin@kerrstreet.com.

f) Clients are responsible for arranging the pick-up of their Choose Fresh order each week that they are available during allocated KSM Food Market times. Orders will not be held for any duration beyond the weeks that they are available. Kerr Street Mission takes no responsibility and offers no refunds for any missed pick-ups or otherwise arranged options.

3. Payment of Fees

a) A valid credit card is required for orders to be processed through the Kerr Street Mission accounting department.

b) The service will be billed monthly on the 17th of the month through “Blackbaud Merchant Services” or “BMSS”. When your charge has been processed, you will receive an email confirmation of your order.

c) If any changes need to be made on your payment option, it is your responsibility to contact Kerr Street Mission before the 10th of the month prior to the charge taking place. Failure to do so may result in ineligibility to participate in the Choose Fresh program.

d) Kerr Street Mission is not responsible for any bank charges incurred due to insufficient funds, overcharge fees, or any other fees that may apply.

e) Kerr Street Mission does not provide refunds.

4. Cancellation and Termination

a) You may cancel your participation in the Choose Fresh Monthly program by emailing admin@kerrstreet.com or calling 905-845-7485. Requests must be made before the 10th of the month to ensure no further charges are applied.

b) If you cancel the Service after the 10th day of the month, you will receive one final charge on the 17th. Once that has been processed, you will not be charged again.

c) We reserve the right to modify or terminate Choose Fresh service for any reason, without notice, at any time.
